These Terms of Service ("Terms") govern your use of mtd-construction.com (the "Site") and any estimate request, assessment, or communication you submit through it, provided by MTD Construction ("MTD," "we," "us"). By using the Site or submitting a form, you agree to these Terms. If you do not agree, do not use the Site.
1. Our Services
We provide design-build general contracting services including kitchen and bathroom remodeling, home additions, custom homes, basement and garage finishing, decks/patios/pergolas, and roofing, throughout Greater Colorado Springs. The free project estimate offered on this Site is an introductory consultation and does not, by itself, create a signed construction contract, establish pricing, or reserve a construction schedule. A separate written agreement, signed by both parties, governs any paid project.
2. No Guarantee of Specific Results Outside a Signed Contract
Figures, calculators, and assessments on this Site — including the Renovation Investment Estimator and the Remodel Readiness Score — are illustrative and for general informational purposes only. They are not a bid, quote, appraisal, or guarantee of any specific price, schedule, or outcome, and should not be relied upon for financial or construction planning purposes. Our advertised guarantees regarding start date, completion date, and price apply only as, and to the extent, expressly set out in your signed written project contract with MTD, which controls over any statement made on this Site in the event of a conflict.
3. Communications Consent (Calls, Texts & Email)
By submitting your phone number and checking the consent box on our estimate request form, you expressly agree, as described in our Privacy Policy, that MTD (and vendors acting on our behalf) may contact you by phone, SMS/text message — including autodialed or prerecorded messages — and email regarding your project inquiry. This consent is not required to purchase any goods or services from MTD. You may revoke consent at any time by replying STOP to any text, or by contacting us using the information in Section 12. Standard message and data rates may apply.
4. Eligibility & Your Responsibilities
- You must be at least 18 years old and have legal authority over the property at issue to request an estimate.
- You agree to provide accurate, complete information about your project, property, and contact details.
- You agree to use the Site lawfully and not to interfere with, disrupt, or attempt unauthorized access to it.
5. Intellectual Property
All text, images, video, design, and other content on this Site is owned by or licensed to MTD Construction and may not be copied, reproduced, or reused without our prior written permission.
6. Disclaimer of Warranties
The Site and its content, tools, and assessments are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. Nothing in this Section limits any written warranty MTD provides under a signed construction contract.
7. Limitation of Liability
To the fullest extent permitted by law, MTD Construction is not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site. Our total liability arising from the Site itself is limited to the greatest extent permitted by law; liability related to an actual construction project is governed exclusively by your signed project contract.
8. Indemnification
You agree to indemnify and hold MTD Construction harmless from any claim or demand, including reasonable attorneys' fees, arising out of your misuse of the Site or your violation of these Terms.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising from your use of this Site (as distinct from a signed construction contract, which will contain its own dispute-resolution terms) will be subject to the exclusive jurisdiction of the state and federal courts located in El Paso County, Colorado, unless the parties agree in writing to binding arbitration.
10. Third-Party Links & Tools
The Site may link to or embed third-party tools (e.g., scheduling widgets, analytics, review platforms). We are not responsible for the content, accuracy, or privacy practices of those third parties.
11. Changes to These Terms
We may update these Terms from time to time; the "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted means you accept the updated Terms.
